DMCA and Copyright

1. Our designated agent

Knolyz hosts courses, videos, and other material uploaded by creators. To receive notices of claimed copyright infringement, we have designated an agent with the U.S. Copyright Office under 17 U.S.C. § 512. Send all copyright notices and counter-notices to:

Only copyright matters should be sent to this address. Other questions go to support@knolyz.com.

2. Sending a takedown notice

If you believe material on Knolyz infringes your copyright, send a written notice that includes all of the following, as required by 17 U.S.C. § 512(c)(3):

1. Your physical or electronic signature, or the signature of someone authorized to act for you.

2. Identification of the copyrighted work you say is being infringed. If one notice covers several works, give a list.

3. Identification of the material you say is infringing and information reasonably sufficient for us to find it, such as the URL.

4. Your name, mailing address, telephone number, and email address so we can reach you.

5. A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.

6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.

Incomplete notices may be returned to you for correction. We may also contact you for clarification.

3. What we do with a notice

We log every notice we receive with the date, the sender, the URL, and the work identified. When a notice is complete and valid, we remove or disable access to the material expeditiously, with a target of 24 to 48 hours. We notify the creator who posted the material and give them a copy of the notice. If the creator sends a valid counter-notice, we follow section 4.

4. Filing a counter-notice

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice that includes all of the following, as required by 17 U.S.C. § 512(g)(3):

1. Your name, address, and telephone number.

2. Identification of the material that was removed and where it appeared before it was removed.

3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.

4. A statement that you consent to the jurisdiction of the federal district court for the district where your address is located, or if you are outside the United States, for any judicial district where Knolyz may be found, and that you will accept service of process from the person who sent the original notice or their agent.

5. Your physical or electronic signature.

When we receive a valid counter-notice, we forward it to the person who sent the original notice and wait 10 to 14 business days. If that person does not tell us they have filed a court action, we restore the material, with a target of 24 hours after the waiting period closes. If a court action is filed, the material stays down while the dispute is resolved.

5. Repeat infringement

Every valid takedown notice counts as one strike against the creator account that posted the material. Counter-notices that result in material being restored do not count as a strike. An account that receives 2 strikes within 90 days is suspended. An account that receives 3 strikes is terminated. When an account is suspended or terminated, the creator may export their content and student data for 30 days, consistent with the export rights in our Terms of Service.

We do not terminate accounts for notices we determine to be invalid or abusive, and repeated invalid notices from the same sender may be reported.

6. False notices

Knowingly making a material misrepresentation in a takedown notice or counter-notice can make you liable for damages, including costs and attorney fees, under 17 U.S.C. § 512(f). Please make sure your notice is accurate before you send it.

7. Creators and copyright

By uploading material to Knolyz you confirm you own it or have the rights needed to publish it, as set out in our Terms of Service. If you believe someone used your work in a course without permission, use the process above rather than contacting them directly.
